General Terms and Conditions for Tourist Arrangements / Pre-contractual Information

1) CONTENT OF GENERAL TERMS AND CONDITIONS FOR TOURIST ARRANGEMENTS

The general terms and conditions of the provision of services are an integral part of the contract between the company FoodIT Travel Agency, owned by Zoran Šimunić, as a travel agency, and the traveller who accepts the selected tourist service.

Everything stated in the General Terms and Conditions represents a legal obligation for both the traveller and the FoodIT Travel Agency, owned by Zoran Šimunić (hereinafter referred to as the FoodIT Travel Agency).

General terms and conditions are published on the FoodIT Travel Agency’s website https://foodtrawell.com.

All information, data and photographs related to accommodation were collected by the FoodIT Travel Agency from the end service providers.

Even though FoodIT Travel Agency’s employees have checked all information, FoodIT Travel Agency does not assume responsibility for errors, omissions and delays in updating this or any other part of the website.

2) PRE-CONTRACTUAL INFORMATION

By sending or placing an inquiry for an offer, signing a Contract or purchasing an arrangement between the agency and the traveller, of which these Terms and Conditions are an integral part, the traveller confirms that he/she is familiar with and accepts the General Terms and Conditions for tourist arrangements of the FoodIT Travel Agency and that he/she is familiar with and accepts all pre-contractual information.

The agency will provide the traveller with appropriate pre-contractual information: the main features of the trip included in the package (destination, travel plan, periods of stay, number of nights, transport information, location and characteristics of accommodation, meal plan, excursions, visits, language in which the services will be provided, suitability for persons with reduced mobility), the name and address of the organizer (in case the agency acts as a trader) with information on the telephone number and e-mail address, the price of the package including taxes, information on additional fees, charges and other costs, payment method, the minimum number of people required to realize the package, general information on the conditions of the destination country regarding passports and visas and on the health formalities of the destination country, information that the traveller can terminate the contract at any time while paying an appropriate fee, a travel insurance package.

Pre-contractual information forms an integral part of the Travel Package Agreement. The agency will provide the passenger with any change in pre-contractual information in a clear and comprehensible manner.

3) CATEGORIZATION AND DESCRIPTION OF SERVICES

The accommodation units offered are described according to the official categorization of the local tourist organization at the time of issuing the operating permit.

The standards of accommodation, food, services, etc. in specific places and countries are different and not comparable.

Information that the traveller receives at other points of sale does not bind FoodIT Travel Agency to a greater extent than the information published on our website, catalogue and other printed materials of the agency.

If the traveller has not expressly contracted a room/apartment with special features, he/she will accept any officially registered room/apartment for rent in the specified facility, described in the catalogue and price list.

If possible, FoodIT Travel Agency will try to meet additional accommodation requirements (comfort, room orientation, floor, etc.), but cannot guarantee that such requests will be fulfilled.

4) CONTENT AND PRICE OF THE PACKAGE

The prices of the services are highlighted with each accommodation unit/arrangement/service and include the services described in the reservation. Special services are services provided by the accommodation unit, but are not included in the price, and therefore the traveller pays for them separately, as a separate service.

Special services should be requested at the time of registration; they are added to the price of the accommodation service and are included in the final calculation.

Optional services are services provided by the FoodIT Travel Agency and are not related to the offer of the rented accommodation unit.

The prices listed in the FoodIT Travel Agency programs are based on contracts with our partners and do not have to match the prices published at the destination where the traveller is staying, and any difference in price cannot be subject to complaint.

The tour operator may stipulate that the traveller pays for certain services that he/she will use abroad at the location in the currency of the country he is in. For services that are paid at the location, the traveller shall submit any complaints directly to the service provider.

FoodIT Travel Agency may, no later than 21 days before the start of the trip, request an increase in the agreed price if, after the conclusion of the contract, there has been a change in exchange rates or an increase in the price of services that make up the package, in particular an increase in transportation costs, including fuel costs, an increase in fees (at airports and other ports, etc.), or an increase in the price of accommodation, which affect the price of the trip.

In that case, the price of the arrangement will increase in proportion to the increase in the price of the calculation elements on the basis of which the price was formed.

The traveller undertakes to accept an increase in the agreed price of up to 10 %. If the agreed price increases by more than 10 %, the traveller has the right to cancel the arrangement, provided that he/she is obliged to notify the FoodIT Travel Agency in writing within 2 working days of receiving the notification. In the event of cancellation of the arrangement, the traveller is not entitled to compensation for damages.

If the traveller does not submit his/her cancellation to FoodIT Travel Agency in writing and within the specified deadline, he/she is deemed to agree with the price change.

FoodIT Travel Agency reserves the right to change published prices in the event of the changes in the prices of accommodation and services by the service provider.

Check-in is not possible before 3 p.m. on the day of arrival, and check-out is no later than 10 a.m. on the day of departure, unless otherwise stated in the travel program.

5) RESERVATION REGISTRATION

Registering for the reservation of a package is sent electronically by filling in the provided form available on the website of the FoodIT Travel Agency, by phone or e-mail.

When registering, the traveller is required to provide all accurate information requested in the reservation form about themselves and the persons he/she is registering for the trip.

FoodIT Travel Agency does not assume responsibility for the accuracy of the information provided by the traveller when making a reservation.

In the event of inaccurate information, FoodIT Travel Agency reserves the right to change prices and charge the difference in price at the location.

6) RESERVATIONS AND PAYMENTS

Inquiries and reservations for packages are accepted electronically and by phone, in writing or in person at the agency’s office. When making a reservation, the traveller confirms that he/she is familiar with these General Terms and Conditions of Service, which he/she has previously carefully studied, and that he/she accepts them in full.

In this way, everything stated in these General Terms and Conditions becomes a legal obligation for both the traveller and the agency.

The Agency makes available to the contracting party appropriate promotional material or program in printed or electronic form, presents him/her with all relevant information about the service, and hands over or refers him/her to the General Terms and Conditions that are an integral part of this contract.

When making a reservation, the traveller is obliged to provide all the information required by the reservation process. The reservation is valid upon payment by the traveller, any other confirmation, verbal or written, is not valid as a reservation.

Reservation requires an advance payment according to the offer in the specified percentage of the total price, and the remaining amount is to be paid no later than 21 days before the beginning of the service – unless otherwise agreed.

If there are 21 or fewer days left before the departure, 100 % of the accommodation price per approved request is to be paid.

Payment is possible to the IBAN account of the FoodIT Travel Agency or online by credit card.

If the traveller fails to fulfil his/her obligation no later than 21 days before departure, he/she will be deemed to have cancelled the reservation without the possibility of refunding the advance payment.

When purchasing services from a distance, by dictating the traveller’s credit card number, he/she is deemed to fully accept these General Terms and Conditions.

Upon receiving the entire amount for the selected service, the traveller will be sent a voucher with exactly indicated contracted and paid services. The voucher serves as proof of the reservation of services. The traveller is obliged to hand over the voucher upon arrival at the accommodation facility/activity location, and the reserved services will be provided on the basis of the voucher.

If more people than indicated on the travel documents (voucher) arrive at the reserved accommodation unit/activity, the service provider has the right to deny service to unannounced travellers or provide services to all travellers with an additional charge for unannounced travellers at the location. By paying for the reservation, the traveller confirms that he/she is fully familiar with all the characteristics and conditions under which a certain accommodation unit/arrangements or service is offered to him/her.

By paying for the reservation, the traveller confirms that he/she accepts the General Terms and Conditions for tourist arrangements of FoodIT Travel Agency. By paying for the reservation, everything stated in these Terms and Conditions becomes legally binding for both the traveller and the FoodIT Travel Agency.

Note: All payments are made in euros. The amount for which your credit card will be charged is obtained by converting the price in euros into the currency of the country in which the recipient of the service is located according to the valid exchange rate list of the Croatian National Bank according to the middle exchange rate on the day of payment.

At the moment of payment, the amount is converted into your national currency according to the valid exchange rate list of the Croatian National Bank. As a result of the price conversion, there is a possibility of a slight difference in the amount in comparison to the original price displayed on our website or in the offer.

7) FoodIT Travel Agency’s RIGHT TO CHANGES AND CANCELLATION

The FoodIT Travel Agency undertakes to provide the traveller with accommodation in rented facilities during the reserved period, except in case of exceptional circumstances (war, riots, strikes, terrorist actions, sanitary disturbances, natural disasters, interventions by competent authorities, etc.).

FoodIT Travel Agency may propose changes to the reserved accommodation/arrangement or cancel the rented accommodation in whole or in part if extraordinary circumstances occur before or during the duration of the arrangement that cannot be avoided or eliminated, and if they had occurred at the time of publication and sale of the program, they would have been a justified reason for FoodIT Travel Agency not to publish the offer and not to receive reservations and confirmations of the rental of the accommodation units in question. If a traveller makes a payment for a reservation that FoodIT Travel Agency cannot fulfil (online or based on an incorrect offer), the traveller will be offered an alternative.

If the FoodIT Travel Agency is able to offer the traveller an alternative, the booked package can only be changed with the traveller’s approval.

The offered alternative must be of the same or higher quality than the quality of the reserved accommodation. If the traveller accepts the alternative and if it is more expensive, he is obliged to pay the difference. If the alternative is less expensive, the FoodIT Travel Agency will refund the difference to the traveller.

FoodIT Travel Agency is obliged to inform all travellers who have confirmed their arrival by payment of any change in reservation or cancellation immediately upon the occurrence of extraordinary circumstances, and if it is impossible to find alternative accommodation, to refund them the unrealized amount, reduced by administrative agency costs.

8) THE RIGHT OF FoodIT Travel Agency TO TERMINATE THE TRAVEL PACKAGE CONTRACT BEFORE THE BEGINNING OF THE PACKAGE

FoodIT Travel Agency may terminate the travel package contract before the beginning of the package and fully refund all payments received for the package, without any obligation to compensate the traveller if the number of people registered for the package is less than the minimum number specified in the contract or travel program that is an integral part of the pre-contractual information and if it notifies the traveller of the termination of the contract within the deadline specified in the promotional material or travel program, i.e.:

– 20 days before the beginning of a package for trips lasting 6 or more days;

– 7 days before the beginning of a package for trips lasting from 3 to 5 days;

– 48 hours before the beginning of a package for trips lasting less than two days.

FoodIT Travel Agency may terminate the travel package contract before the beginning of the package and fully refund all payments received for the package to the traveller, without any obligation to compensate the traveller, if FoodIT Travel Agency is prevented from performing the contract by extraordinary circumstances that could not be avoided and if it notifies the traveller of the termination of the contract without undue delay before the beginning of the package.

In the event of termination of the contract under this article, the FoodIT Travel Agency will refund to the traveller all payments made for the traveller without undue delay, and no later than 14 days from the termination of the travel package contract, provided that the traveller has sent the information necessary for the refund to the FoodIT Travel Agency.

9) TRAVELLER’S RIGHT TO CHANGES AND CANCELATION OF TRAVEL

In case the traveller wishes to change or cancel a reservation made at his/her request, he/she must do so in writing (by e-mail). A change is considered to be a change in the number of people or the date of the beginning and/or end of the service, and/or a change in the name of the traveller no later than 30 days before the beginning of the service.

The reservation will be changed at no additional cost if possible, but the change of reservation will be charged depending on the request of the service provider, i.e. accommodation facility, activity, transport company or similar.

If a change to the reservation is not possible, and if the traveller cancels the confirmed reservation as a result, the cancellation conditions listed below apply. Changing the accommodation unit and any change within 30 days before the beginning of the reservation and during the use of the reservation is considered a cancellation of the reservation.

In the event of cancellation of a fixed confirmed hotel accommodation reservation, the date of receipt of the written cancellation constitutes the basis for calculating cancellation costs as follows:

– 30 % of the total price of the reservation is charged for cancellation of the reservation up to 30 days before the beginning of the service

– 40 % of the total price of the reservation is charged for cancellation of the reservation from 22 up to 29 days before the beginning of the service

– 50 % of the total price of the reservation is charged for cancellation of the reservation from 15 up to 21 days before the beginning of the service

– 80 % of the total price of the reservation is charged for cancellation of the reservation from 8 up to 14 days before the beginning of the service

– 100% of the total price of the package is charged for cancellation of the reservation from 0 up to 7 days before the beginning of the service, including the day of departure, i.e. for “no-show” or for terminating the trip caused by the passenger.

If the traveller does not arrive at the reserved accommodation by 8:00 p.m. on the day of the beginning of service, and has not contacted the agency or service provider, the reservation is considered cancelled and cancellation costs are calculated as stated above. If the real cancellation costs exceed the above costs, the agency reserves the right to charge the real costs incurred.

The Agency does not reimburse the traveller for the costs of obtaining travel documents or visas related to a reservation that the traveller cancels.

FOR CLOSED GROUP TRIPS (including school trips) the following conditions apply:

– CANCELATION BY INDIVIDUALS

Any cancelation must be reported to FoodIT Travel Agency in writing or by e-mail. In the event of an individual cancelling a trip, the Agency retains the following amounts from the total price of the trip for the costs of the work performed up to that point:

– up to 75 days before the trip: 30 %

– between 74 and 30 days: 50 %

– between 29 and 15 days: 75 %

– between 14 and 0 days: 100 % (regardless of the reason)

Exceptions to this include death in the immediate family, unplanned military service (documented by military conscription) or the traveller’s hospitalization due to illness (which must be documented by hospital records).

– CANCELATION BY A GROUP OR PART OF A GROUP

Part of a group means 5 or more people. Any cancelation by a group or part of a group must be reported to FoodIT Travel Agency in writing or by e-mail.

In the event of cancellation, the Agency retains the following amounts from the total price of the trip for the costs of the work performed up to that point:

– any cancellation up to 90 days before the travel: 30 %

– cancellation between 89 and 60 days before the travel: 50 %

– between 59 and 0 days before the travel: 100 %.

WE RESERVE THE RIGHT to regulate special cancellation conditions for certain groups with which the groups will be informed in the offer itself.

10) FoodIT Travel Agency’s OBLIGATIONS

FoodIT Travel Agency is obliged to ensure the provision of services and selection of service providers with the scrutiny of an informed economist, and to take care of the rights and interests of the travellers in accordance with the good traditions in tourism.

FoodIT Travel Agency is obliged to ensure that the travellers are provided with all contracted services and is responsible for possible non-performance of the services or parts thereof. FoodIT Travel Agency disclaims any responsibility in case the services have been modified or not carried out due to force majeure, as well as for delays of transportation means for which the carrier is not responsible according to positive regulations and international conventions. In these cases the traveller bears all additional costs.

11) TRAVELLER’S OBLIGATIONS

Travellers are obliged to own valid travel documents. FoodIT Travel Agency does not guarantee the obtainment of visas. Should the traveller not fulfil the stated obligations or his/her application for visa is rejected, he/she will be deemed to have cancelled the travel.

The cost of loss or theft of documents during the travel is borne by the traveller.

The traveller is obliged to comply with the customs and foreign exchange regulations of the Republic of Croatia as well as the countries in which he/she is staying during the travel, and to adhere to the house rules in the rented accommodation unit, cooperate with service providers in good faith upon arrival at the rented accommodation unit, and present the service provider with the voucher indicating the exact number of people and the types of services to be provided.

In case of non-compliance with these obligations, the traveller bears the costs and is liable for any damage caused.

By confirming the reservation, the traveller undertakes to pay for any damage caused to the service provider at the location. We recommend that each traveller personally checks the www.mvep.hr website and searches for the list of high or moderate risk countries according to the opinion of the Ministry of Foreign and European Affairs of the Republic of Croatia.

We recommend that all travellers who are not Croatian citizens and own no Croatian travel documents inform themselves about the country they travel to and the conditions for travelling to the country, taking into account the different regulations that apply to citizens of individual countries, before paying for the package.

FoodIT Travel Agency may refer the traveller to a source of information, but in no way assumes responsibility for the consequences that may arise for the traveller due to non-compliance with these regulations. Invalid travel documents, or visa denials that result in cancellation of the trip, do not bind FoodIT Travel Agency in any way, and the conditions for cancellation of the trip apply.

FoodIT Travel Agency disclaims any responsibility for damage that would result from non-compliance with the regulations of individual countries or that would be caused by invalid travel documents.

12) LUGGAGE

Luggage is transported at the risk of the traveller, so it is recommended to insure the luggage with an insurance company. FoodIT Travel Agency is not responsible for destroyed or lost luggage, as well as for theft of luggage or valuables in the accommodation unit or during the travel.

The traveller shall report damaged or lost luggage to the accommodation provider, the airline or bus company, and the relevant police station. The transportation of luggage up to a certain weight, determined by the carrier, is free of charge.

13) TRAVEL CANCELLATION INSURANCE

If the traveller anticipates at the time of booking that he or she will have to cancel the trip due to certain circumstances, the agency recommends getting a cancellation insurance policy. The insurance premium is calculated depending on the value of the trip, and according to the price list of the insurance company with which the Agency has a contract. If the traveller does not have a cancellation insurance contract, the agency reserves the right to payments according to the rules set out in Article 7 of this Agreement.

By getting the cancellation insurance policy, the traveller transfers all of his claims to the insurance company whose cancellation insurance policy he holds, and the agency undertakes to provide the traveller with all documentation related to the reservation that is necessary to make claims against the insurance company. All other insurance conditions are included with the insurance policy, and we recommend that each traveller reads them personally.

14) TRAVEL INSURANCE

The agency also recommends a travel insurance policy: against the risk of accidents and illness while travelling, insurance against damage and loss of luggage, as well as voluntary health insurance.

By signing the Contract or purchasing an agency-traveller package, of which these Terms and Conditions are an integral part, it is considered that travellers have been offered and recommended the additional insurance listed in the previous paragraph.

In the event that the traveller requires the aforementioned insurance, it can be arranged directly with one of the insurance companies or with the Agency whereby the Agency acts only as an intermediary. We recommend that you carefully study the insurance terms and conditions before purchasing.

15) RESOLVING COMPLAINTS

Every traveller – the holder of the Agency-Traveller Contract has the right to complain about the non-provided contracted service.

If the offered services provided are of poor quality, the traveller can demand proportionate compensation by submitting a written complaint.

Any traveller has the right to complain about a non-provided paid service. Any traveller – the holder of a confirmed reservation, submits the complaint individually.

On the day of arrival, the traveller is obliged to immediately complain about the inadequate service to the representative of the service provider (receptionist or accommodation owner, travel attendant, carrier, etc.) and inform the FoodIT Travel Agency or its authorized representative.

The traveller is obliged to first inform the service provider and try to find a satisfactory solution with them. The traveller is obliged to cooperate with the service provider and the Agency in good faith to eliminate the cause of the complaint. If the traveller accepts the offered solution to the complaint at the location, which corresponds to the paid service, the Agency is not obliged to accept a subsequent complaint.

If the problem was not resolved even after the on-site intervention, the traveller must send a written complaint together with supporting documents and photos proving the basis for the complaint to the Agency, by e-mail or post at the latest 8 days after returning from the trip.

The Agency will only consider fully documented complaints received within 8 days following the end of the trip.

During the resolution process, and in total no longer than 14 or 28 days after lodging the complaint, the traveller irrevocably renounces mediation by any other person, arbitration by competent institutions, as well as providing information to the media. Likewise, during this period, the passenger waives the right to sue.

The maximum compensation per complaint may reach the amount of the advertised part of the services, and may not include services already used or the entire amount of the service. This excludes the passenger’s right to compensation for ideal damage.

The Agency cannot be held responsible for any climate conditions, cleanliness and temperature of the sea, as well as any other similar situation and event that may cause traveller’s dissatisfaction and do not directly concern the quality of the booked accommodation unit/activity or other service (e.g. bad weather, bad beach management, too great a distance from public beaches from the accommodation, excessive traffic jams, theft or damage to property, etc.).

FoodIT Travel Agency does not accept complaints about reservations at specially reduced prices, the so-called “last minute offers”, accommodation according to the principle of “no name hotel” and “fortuna” system, nor other special offers of the “roulette formula”.

16) COURT’S JURISDICTION

The traveller and the Agency will endeavour to resolve any disputes regarding this Agreement amicably, otherwise they will submit it to the competent Municipal Court in Zagreb, and the applicable law will be Croatian law.

According to the Act on the Provision of Tourism Services, a traveller may submit a proposal for dispute resolution to a notified body for alternative consumer dispute resolution in accordance with the law governing alternative consumer dispute resolution. 17) LIABILITY INSURANCE

Pursuant to the Act on the Provision of Tourism Services, FoodIT Travel Agency has concluded liability insurance with Wiener osiguranje Vienna Insurance Group d.d., Zagreb, Slovenska ulica 24, for damages caused to the traveller due to non-performance, partial performance or undue performance of obligations No. 13-0071879-01 until 11 July 2025.

The Agency will inform the traveller with the content of the Liability Insurance for the damage caused by the FoodIT Travel Agency to the traveller by non-performance, partial performance or undue performance of obligations relating to the package, and by signing the Contract and paying for the package the traveller confirms being informed of the content of the Liability Insurance.

18) PROTECTION OF PERSONAL DATA

The traveller provides personal data voluntarily. The traveller’s personal data is necessary in the process of realizing the agreed packages and will be used for further communication. FoodIT Travel Agency undertakes not to reveal personal data of travellers out of the country except for the purpose of realizing the agreed packages.

The exception to revealing personal data to third parties relates to the contracting of travel insurance policies, i.e., if a traveller concludes an insurance policy, then his/her personal data will be forwarded to the insurance company.

Travellers’ personal data will be stored in a database, in accordance with the Board’s Decision on the method of collecting, processing and storing personal data. Data collected via the reservation form is considered personal data and is subject to protection prescribed by the applicable regulations of the Republic of Croatia.

By providing their personal data and accepting these general terms and conditions, the traveller agrees that the FoodIT Travel Agency and its related parties may use and utilize the aforementioned personal data for promotional purposes, such as (but not limited to) sending newsletters by e-mail, posting on Facebook, and informing them in other ways about promotional activities, products and services offered.

By accepting these general terms and conditions, the traveller agrees to provide such personal data for use by third parties, including, but not limited to, affiliated companies of FoodIT Travel Agency for marketing purposes, using services on the website to improve the user experience, conducting marketing and promotional activities, and delivering marketing communications.

19) INFORMATION

The information that the traveller receives at the registration point does not bind the organizer to a greater extent than the information and notices stated in the travel program itself.

20) FINAL PROVISIONS

These terms and conditions and travel instructions exclude all previous terms and conditions and travel instructions. The general terms and conditions for tourist packages are an integral part of the contract that the traveller concludes with the FoodIT Travel Agency or the authorized tourist agency with which he/she registered for a trip organized by the FoodIT Travel Agency.

STATEMENT ON PERSONAL DATA PROTECTION, COLLECTION AND USE

By using, visiting and browsing this website, you accept and consent to the collection of personal data necessary for the provision of our services.

Everywhere on our website, at data collection points, in various forms and templates, there are explanations about the purpose of collecting and using users’ personal data.

Most of our services on our website do not require a login, so the site can be used without revealing your identity. However, some services require you to log in. When logging in, you must complete certain fields (some are mandatory, others are optional) and choose a username and password.

The data is later used by our employees to provide the selected service. The user does not necessarily need to log in to our website, in which case he/she will be denied access to certain parts of the website and FoodIT Travel Agency will not be able to respond to his/her inquiry or request.

The user does not necessarily have to fill out the forms, but if he/she does so, he/she voluntarily agrees to all the stated conditions for the collection of personal data and their use for the purpose of providing our services.

We are committed to protecting the privacy of all our customers. We only collect user data that is necessary to provide our services. All user data is kept strictly confidential and is only accessible to employees who need it to provide the services.

We only provide our partners (e.g. hoteliers, transport companies, airlines) with the data they need to provide their services. All our employees and business partners are responsible for respecting the principles of privacy protection.

We never use the data collected in this way for promotional purposes. The data we use for promotional purposes is collected exclusively through, for example, the Newsletter form where the user is informed for what purpose their e-mail address will be used.

SECURITY OF ONLINE PAYMENTS

Revolut Payment Gateway takes care of the confidentiality and security of your data when authorizing credit cards. The contracting parties will try to resolve all possible disputes related to the Contract (including its execution and termination) amicably, and if this is not possible, the court in Zagreb, Croatia shall have jurisdiction.

The applicable law is the law of the Republic of Croatia (excluding its conflict of laws provisions that would indicate the application of foreign law).

The General Terms and Conditions of Travel Organization are an integral part of every Travel Organization Agreement concluded by the Traveller with the Organizer. They comply with the EU Directive 2015/2302 of the European Parliament and of the Council of 25 November 2015 on Package Travel and Linked Arrangements (available at the link: http://eur-lex.europa.eu/legal-content/HR/TXT/PDF/?uri=CELEX:32015L2302&from=HR) as well as the Act on the Provision of Services in Tourism (Official Gazette 130/2017), which has been in force since 1 July 2018 (available at the link: https://narodne-novine.nn.hr/clanci/sluzbeni/2017_12_130_2982.html).

The Traveller’s right to compensation or price reduction prescribed by the Act on the Provision of Services in Tourism and international conventions does not affect the Traveller’s rights in accordance with Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91; Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers’ rights and obligations; Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of accidents; Regulation (EU) No 1177/2010 of the European Parliament and of the Council of 24 November 2010 concerning the rights of passengers when travelling by sea and inland waterway and amending Regulation (EC) No 2006/2004; Regulation (EU) No 181/2011 of the European Parliament and of the Council of 16 February 2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004.

The Traveller has the right to file claims for price reduction and/or compensation for damages in accordance with the Act on the Provision of Services in Tourism and in accordance with the international conventions and regulations referred to in the previous paragraph of these General Terms and Conditions. The compensation for damages or price reduction to which the Traveller is entitled in accordance with the Act on the Provision of Services in Tourism and in accordance with the international conventions and regulations referred to in # 20 of these General Terms and Conditions shall be deducted from each other in order to avoid excessive compensation and/or excessive price reduction.

The right of the Traveller to request a price reduction based on the provisions of the Act on the Provision of Services in Tourism that regulate the issues of amending the package travel contract before the beginning of the package, the execution of the package, and the price reduction and compensation for damages expires within two years. The limitation period begins on the first day after the day on which the package should end according to the contract.

The number of places/offers of our packages is limited and we reserve the right to cancel promotions or change prices at any time.

Operating conditions are in accordance with the currently valid regulations and may be changed depending on the legal regulations. FoodIT Travel Agency will strive to promptly apply legal changes in the online instructions – that is, they apply to the currently valid regulations and rules, even if they are not simultaneously available online.
